1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and LEGITRISE - FZCO ("Company," "we," "us," or "our"), operating as Melody of Us, concerning your access to and use of the melodyofus.com website and our custom song creation services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

3. SERVICES

Melody of Us provides custom song creation services for personal use. We create personalized songs based on information provided by customers about their relationships, special occasions, and personal stories.

4. ELIGIBILITY

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement.

5. ORDERS AND PAYMENT

5.1 All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason.

5.2 Prices are displayed in the currency selected at checkout and are subject to change without notice.

5.3 Payment must be received in full before we begin work on your custom song.

5.4 All sales are final once production has begun. See our Refund Policy (Section 8) for details.

6. CUSTOM SONG CREATION PROCESS

6.1 You agree to provide accurate, complete, and truthful information for your custom song.

6.2 Production typically takes 24-72 hours depending on the service tier selected. Rush delivery options may be available for an additional fee.

6.3 We reserve the right to refuse to create content that is offensive, defamatory, illegal, or violates the rights of others.

6.4 Songs are created by professional artists based on the information you provide. Minor variations in style and interpretation are expected as part of the creative process.

7. INTELLECTUAL PROPERTY

7.1 Upon full payment, you receive a personal, non-exclusive, non-transferable license to use your custom song for personal, non-commercial purposes only.

7.2 We retain all intellectual property rights to the musical composition, arrangement, and performance. You may not resell, redistribute, reproduce for commercial purposes, or claim ownership of the song.

7.3 You grant us a perpetual, royalty-free license to use your custom song (or portions thereof) for marketing, promotional, and demonstration purposes, including but not limited to social media, website content, and advertisements. We will not share personally identifiable information without your explicit consent.

7.4 All content on our website, including text, graphics, logos, and software, is the property of LEGITRISE - FZCO and is protected by copyright and intellectual property laws.

8. REFUND POLICY

8.1 We offer a satisfaction guarantee. If you are not satisfied with your custom song, please contact us within 7 days of delivery.

8.2 Refunds are available under the following conditions:

• The song was not delivered within the promised timeframe (excluding delays caused by incomplete or inaccurate information provided by you)
• The song significantly deviates from the information and preferences you provided
• Technical issues prevent you from accessing or downloading your song

8.3 Refunds will not be granted if:

• Production has been completed and the song has been delivered as specified
• You change your mind after production has begun
• You are dissatisfied with subjective elements of artistic interpretation
• You provided incomplete or inaccurate information
• You refused our attempts to revise the song

8.4 Refund requests must be submitted in writing to our customer support email. We will review all requests on a case-by-case basis.

8.5 If a refund is approved, it will be processed within 5-10 business days to the original payment method.

9. DELIVERY

9.1 Songs are delivered digitally via email or download link to the email address provided at checkout.

9.2 You are responsible for ensuring the email address provided is accurate and that you can receive our communications.

9.3 We are not responsible for delivery failures due to incorrect email addresses, spam filters, or technical issues on your end.

10. USER CONDUCT

You agree not to:

• Provide false, misleading, or fraudulent information
• Use our services for any illegal purpose
• Request content that is defamatory, obscene, threatening, or violates the rights of others
• Attempt to reverse engineer, copy, or replicate our creative process
• Resell or commercially exploit songs created by our service
• Impersonate another person or entity
• Interfere with or disrupt our services or servers

11. PRIVACY

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. DISCLAIMERS

12.1 OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

12.2 WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12.3 WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED THROUGH OUR SERVICES.

12.4 Custom songs are creative works and subjective in nature. While we strive for excellence, we cannot guarantee that every song will meet your personal expectations.

13. LIMITATION OF LIABILITY

13.1 TO THE FULLEST EXTENT PERMITTED BY LAW, LEGITRISE - FZCO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

13.2 OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

13.3 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LEGITRISE - FZCO, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Information or content you provide to us

15. MODIFICATIONS TO SERVICES AND TERMS

15.1 We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice.

15.2 We may update these Terms from time to time. The "Last Updated" date at the top of this page indicates when the Terms were last revised.

15.3 Your continued use of our services after any changes to these Terms constitutes your acceptance of the new Terms.

15.4 We will make reasonable efforts to notify you of material changes to these Terms.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

16.2 Any disputes arising out of or related to these Terms or our services shall be resolved exclusively in the courts of Dubai, United Arab Emirates.

16.3 You agree to submit to the personal jurisdiction of the courts located in Dubai, United Arab Emirates.

17. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and LEGITRISE - FZCO concerning our services.

19. NO WAIVER

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
